Q. I've been separated for over 10 years but no legal filings have been made. If I die today does my estranged spouse have the right to my body , funeral arrangements and my estate? We have lived apart and with other partners since separation.

A. If you die today and you're not divorced your spouse gets it all. A separation, legal or otherwise is NOT a disillisionment of marriage. As long as there is no divorce decree your spouse is still your spouse and your partner get's nothing if you die, even if you have a will your spouse can contest it and win based upon the fact that there is no divorce decree.

Is the spouse and taxpayer adjusted gross Income the same if you filed married filing jointly?
Q. I am trying to efile, we filed married filing jointly last year, do I enter the same amount for both our AGI's or do I put the AGI as the taxpayer and zero for the spouse lines? We put the same amount in on Friday and it got rejected. We did end up doing a 1040X for 2007, those are the amounts we used, but got rejected. We are currently trying to use just the 1040 AGI and have not gotten acceptance back yet.

A. If you filed a joint return last year, then your AGI is the same as for your wife's AGI. For example, if your AGI from last year return was $18000, then when asked about your wife's AGI from last year, you would want to put the same number in.

A. Good luck, the local authorities are your best bet unless you signed the check. The IRS will not do anything unless fraud is included as in he forged your signature, the bank could be liable if they accepted a forged signature. You would have to prove it was a forge and the bank knew it. IRS won't really do anything as it is a civil case.

A. Companies cannot intercept tax refunds. State and Federal agencies can. If a private company got the refund, it's because they levied the bank account. The injured spouse form only applies to back taxes, student loans, child support and other state/federal debts. if this applies, the form will cause the rebate check to be split 50/50. However when it gets to the bank account, it can still be levied.

A. A K-3 (non-immigrant spouse) visa takes about 12 months. When she arrives she'll have to adjust status to immigrant. That's a pain and costs $1,010. A CR-1 (immigrant spouse) visa will take longer, maybe 15 to 18 months, but when she gets here nothing further is required. She'll just get the green card in the mail in about a month or two.

A. Laws vary by state. But generally they will have an interest that needs to be clarified, either by a quitclaim deed or other documents recorded showing their interest being accounted for. If not clarified, it will be a cloud on title, which is a bad thing when selling\buying property.

I would consider making a compromise- in the event that you are happily married after 5 years, you will agree to reopen a discussion for adding her to the deed. A. The military can't legally punish her because she is a civilian and a civilian is not subject to UCMJ. They can kick her off post and bar her from returning, though. However, it is still a crime to lie on an official statement, especially in order to get someone in trouble. If she is caught she could possibly face criminal charges in a civilian court.

A. Assuming the veteran was your father... if his wife is already passed and all his children are over 18, then the benefits just stop. You do have to let both those agencies know that he has passed on. If you don't then they would continue to deposit money until they figured it out, and then once they figured it out they would want all that money back at once - and I'm betting they won't make it easy on you, either.

A. Yeah, I was able to do it without a problem. But the key is - he didn't mind the change. He said he didn't care what to eat as long as it's tasty. I was the one to do most of the grocery shopping. So I bought healthy stuff and didn't buy junk. When he gave me a disapointed look I said "I love you therefore I won't buy junk food for you. But look what I got for you instead.." Keep in mind that if he likes twinkies he won't be happy to switch to broccoli. Get him something sweet but healthy. Also if you're the one in charge of cooking - just cook healthy stuff, he'll eat it. Also the schedule is in your control - if you don't want to eat a late dinner just serve an early dinner.

A. It takes a gracious soul to live and support a loved one with clinical depression or any other mental illness. It's a rollercoaster where you are many times picking up the pieces. If you choose to stay as in my case (husband is bipolar II ) please find yourself a support group of kindred people so to speak. And take care of your self because not only does it affect the inflicted person , by the loved ones who love them. A last resort for my husband was a series of electr-convulsive shock treatments aka ECT. A competent psychiatrist can do them and if not will recommed who can. Most insurances cover this. Good luck.
